Terms & Conditions

The Terms & Conditions contained herein are the terms under which The Journeys accepts reservations. Our liabilities are limited. When you make a Payment of Deposit & / or final Payment, it is also an acknowledgement of receipt & acceptance of these  Terms & Conditions.
 
Things to know before you go : The purchase of Packages, Air Inclusive or  Land only (hereinafter referred to as the * Travel Services*) offered by The Journeys constitutes a contractual agreement between The Journeys & the Customer and implies your acceptance of The Journeys Terms & Conditions. Please ensure you read carefully and understand these Terms & Conditions prior to booking.

The contents of this website or promotional documentation may be changed at any time (including, but not limited to, rates and itinerary) without notice and at the sole discretion of The Journeys & Canadian Globetrotters.
 
 
  •  To reserve your place on one of our Journeys, we require our Booking Form to be completed, signed & forwarded to us along with a non-refundable Deposit of $300.00 per person. There may be certain Tours & arrangements, to be advised prior to Booking, which will require additional non-refundable amounts or instant payment for a Permit in order to process the reservations. Some Airfares require full payment at time of booking or to issue the Tickets & guarantee the fare & exact amount will be advised to you accordingly. Please refer below for general Terms & Conditions and your individual Proposal for an explanation. 
  •  Prices are quoted per person based on double occupancy, in United States dollars (US $), unless otherwise indicated, and are based upon the prices of local Service Providers, Exchange Rate, Cost of Fuel, Taxes and other Fees in force at time of booking. All prices are valid upon date of publication on our website or in our proposal to you. However, due to frequent fluctuations in currency exchange, prices listed for your safari or holiday are subject to change with or without notice and surcharges may apply. Unless the customer has paid in full, all prices may be increased at any time and for any reason. Where there is an increase in the total price of the Travel Services after a deposit has been paid and the cumulative increase, except any increase resulting from an increase in retail sales tax or federal goods and services tax, is more 7 per cent, you would be given the opportunity to pay in full to avoid such increase (should it occur) or cancel your booking without penalty.
     
    Includes 
                Airfare : If applicable.
                Meeting / Assistance / Transfers / Porterage : Airport / Hotel round-trip Transfers at all destinations 
                and includes one suitcase per person.
                Accommodation : In twin bedded rooms with private bath or shower.
                Meals : Meals as per itinerary.
                Guide : Professional English-speaking local guide(s).
                Sightseeing & Entrance Fees : By motor coach and Entrance Fees as per itinerary.
                Services Charges & Taxes : All taxes charged by local governments on services, which are part of the 
                program, are included except those imposed by airport authorities (Navigation Fees, Airport
                Improvement Fees, other related Taxes / Fees, Air Travelers Security Charge, Airline Insurance Fee).
     
     Excludes - 
                Personal expenses Telephone and data port charges at some hotels, meals and    drinks, unless 
                otherwise specified in the itinerary. 
                Tips : To guide(s) driver(s) and hotel personnel.
                Insurance : At time of deposit, customers may purchase travel insurance as indicated on
                Registration Form.
     
     
    Activities not included 
    The Journeys shall not be liable for the quality or safety of activities (such as excursions, optional tours, little extras and others) available at destination that customers may wish to participate in and which are not included in the package, nor for any other representation representation made by the operator of any such activities. Any written or oral contract for all such activities shall be deemed to be made between customers and the contract for all such activities and shall be undertaken at the customers own risk of loss, damage or injury. The Journeys shall not be liable in any manner for any complaints or claims that may arise as a result of participation in any such activities which are offered by third parties over whom The Journeys has no control.
  •  Early reservations are recommended. All services are strictly on a request basis, both for air travel and land requirements and subject to availability of seats and hotel / lodge / camp rooms.Reservations are strictly personal and must be accompanied by a deposit or payment in full before they can be considered confirmed. A non - refundable deposit of $300.00 per person is required at time of booking.
     
    Reservations made for travel within 60 days will require full payment at the time of reservation. In the event of services requested not being available, alternative services will be offered. If alternative services are not acceptable, your payment will be refunded in full. Some suppliers may require higher deposit and the same will be advised to you at the time of booking. Please be aware that some airfares require full payment at time of booking and will be advised to you accordingly.
     
     
    Special Assistance
    All customers requiring special care, assistance, attention or treatment must advise The Journeys and the air carrier of any and all specific needs at the time of booking, in order to arrange air transportation, hotel and tour accommodations.
     
     
    Final or Balance Due Payment
    Guaranteed payment of all balances due is no later than 60 days prior to departure date. Reservations made less than 60 days prior departure date must be accompanied by payment in full. If payment of the balance due is not received by the stipulated date, The Journeys reserves the right to cancel your reservation without prior notice and levy applicable cancellation fees.
     
     
    Credit Card Payments
    Visa, Master Card and American Express credit cards are accepted as form of payment. Credit card payments require that the passenger complete and sign the Authorization Form, and return the same to The  Journeys. A 3.5% credit card surcharge (4% on American Express) will be charged. Verbal authorization given by the Agents or customers to The Journeys, for the use of a credit card confirms the reservation, whether or not the Registration Form is signed. However customers must stipulate in writing that the credit card may be used without their signature within 7 days. No services will be provided without receipt of the hard-copy of the signed Authorization Form. Third party payments have restrictions.
  •  If cancellation is necessary, it must be received in writing and would become effective when the written notice is received by The Journeys. Charges will apply in the event of any cancellation. No refunds will be made for any unused portion including hotels, sightseeing, cruises, transfers, meals, international or domestic flights with or without notice unless cancelled or missed by the Supplier. Insurance premiums are non-refundable, in whole or in part, whether cancelled before or after the departure date. The day of departure is excluded when calculating cancellation or change fees. All cancellation fees must be calculated based on the total amount of the products and Travel Services purchase. The Journeys reserves the right to cancel a booking where any payment is not received by the stipulated date (60 day prior to departure).
     
     
    Before Departure
     
    Up to 60 days prior to departure: Loss of the non-refundable deposit paid.
    59 to 45 days prior $    500.00 **
    44 to 30 days prior $ 1,000.00 **
    29 to 15 days prior $ 1,500.00 **
    14 days prior to departure 100% non refundable.
    ** Plus any unrecoverable deposits paid to airlines or suppliers.
     
    Airfares (when purchased through The Journeys) are subject to different rules & cancellation fees. Some airfares may be non-refundable once the booking is confirmed regardless of when it was made. Details will be provided at the time of booking. As well, other suppliers of services at the destination may apply an addition to the above mentioned cancellation and amendment fees.
  •  To protect against cancellation charges, we strongly recommend purchasing Cancellation Protection and Travel Interruption Insurance. Cancellation insurance must be purchased at time of initial deposit. In the event of illness, medical and hospital expenses are the traveler’s responsibility and no refunds will be made, partial or total, for the purchased tour. We urge that you purchase adequate Cancellation, Health and / or Comprehensive inclusive insurance from The Journeys or from your Travel Agent.
  •  It is the full responsibility of customers to obtain at their own expense all necessary travel documents required by all relevant government authorities, including all ports of call, and to comply with the laws thereof. A Canadian or American citizen must be in possession of a passport that must remain valid for a minimum of 6 months from the date of conclusion of their journey. Tour participants must also ensure that they comply with all visa and health requirements of countries they intend to visit. A visa or visas may be required for some or all of the countries visited on the selected safari or holiday.
     
    Canadian & American Citizens born in certain countries may require a visa in addition to a valid passport. Non-Canadian & non-American citizens may have different requirements. A Permanent Resident Card / Green Card will be required for permanent residents / landed immigrants who are not Canadian / American citizens. It is the passenger’s responsibility to ensure that all his or her passport and visa requirements are met. Customers are responsible for checking which documents are required, and then make certain that they have the necessary documents in hand prior to departure. The carrier or relevant authorities, without further recourse or the possibility of a refund, may deny customers boarding privileges failing to provide the required documents.
     
    One (1) parent traveling with a child under age 18 may have to obtain a notarized letter of consent signed by the parent not traveling.
      
    Final tour documents consisting of detailed tour itinerary, vouchers, hotel list, and airline tickets (if purchased through our offices) will be forwarded upon receipt of final payment. For late bookings, express delivery of documents will require a courier delivery fee of $30 to cover extra handling and processing.
     
    Entry to another country may also be refused even if the required information and travel documents are complete. No refund or replacement will be given for lost or stolen travel documents.
     
    The Journeys shall not be held liable for any aid or information given by its employees or the travel agent in connection with obtaining any necessary travel documents or complying with any laws, whether given orally, in writing or otherwise, or for the consequences suffered by any customer resulting from his/her failure to obtain such documents or to comply with such laws.
  •  Health regulations for some countries visited on featured safaris & holidays may require proof of Inoculation and / or Vaccination Certificate. Any inoculations required must be recorded on a valid inoculation certificate and in your possession for inspection at customs/immigration and should be in your possession throughout the entire tour. Please be aware that entry into other countries after a safari or holiday in parts of Africa may require valid yellow-fever inoculation and that entry into that country may be denied when travelling without proper and valid health documents.
     
    Customers, whose physical condition so requires, must ensure that they have a sufficient quantity of any required medication with them, and that they carry such medication in their hand baggage at all times. Customers must also consult competent medical authorities prior to departure about preventive medical measure as regards to the countries to be visited.
  •  
    Unused Portions of Tours
    No refund will be made for any unused accommodations, missed meals, transportation segments, cruise portions, sightseeing tours or any other service. Such unused items are neither refundable nor exchangeable.
     
     
    Accommodations
    Accommodations on twin occupancy basis, is provided at the hotels/lodges/camps as specified or similar. Single room supplements apply to persons occupying sole use of hotel room but travelling with other passengers on the same safari or holiday and sharing transport cost on transfers, game drives, sightseeing and excursions. Quoted single room rate does not necessarily mean single occupancy of a double room. A single individual requesting sole use of hotel room and exclusive use of ground transportation for transfers, game drives, sightseeing and excursions may request a special Single Rate.   Requests for upgrading rooms are subject to additional  charges. Handicapped or non smoking rooms are always on a request basis, subject to availability but not subject to additional costs.  Should  customers   choose to alter their room category upon arrival at destination (upon availability), they must make their own arrangements with the hotel and assume all additional fees levied by them.
     
    All hotel taxes, service charges and government taxes are included in the tour price. The right is reserved to substitute hotels should conditions warrant such change for reasons beyond our control. Rooms are assigned by the respective supplier(s) on a run-of-the-house basis, in category(ies) as specified in the itinerary. Living standards and practices at the destination and standards and conditions with respect to the provision of utilities, services and accommodation may differ from those found in Canada.
     
    Customers acknowledge and accept that hoteliers, in accordance with international standards, request that occupants check in between noon and 3:00 pm and check out by noon on the scheduled day of departure or by noon on the day immediately preceding a late night departure.
     
    Meals & Beverages
    Meals as included on individual safaris and holidays are either buffet meals and/or table d’hôte At times special meals and entertainment are included as shown in the itinerary. Meals ordered through room service are not included and must be paid directly to the establishment. Alcoholic beverages, soft drinks, and bottled water are included only where indicated on select safaris and holidays. On other itineraries all drinks are to purchased and paid directly to the establishments.
     
    The food, water and beverages may not be up to North-American standards. Accordingly, customers assume sole responsibility for any illness suffered while abroad or upon return owing to the quality of the food, water and beverages.
     
     
    Flights & Carriers 
    Customers acknowledge and accept the following :
                   Airlines Clause
    The airlines used in conjunction with safaris and holidays featured in this web site are not to be held responsible for any act, omission or event during the time passenger(s) is not/are not onboard their aircraft. The passenger tickets in use by the airline, when issued, shall constitute the sole contract between the airline and passenger/s. Airfares, where used, are current at the time of publishing the relevant web pages and are subject to change without notice.
     
    If you are purchasing a non-refundable air ticket, please ensure that your travel agent provides detailed regulation governing such airfares. The Journeys cannot be held responsible for any change and / or cancellation penalties associated with non-refundable airfares.

                   Validity of Tickets
    Tickets are made out in the name of the customer and are not transferable. Tickets are valid only on the dates and flights indicated. Unused portions of tickets may not be used for travel on other flights and are not subject to refund at any time.
     
                    
    Changes
    Flights offered by The Journeys are conducted in accordance with the applicable tariffs of the air carrier and pursuant to regulations set out by the Canadian Transportation Agency. All such flights and rates are also subject to approval by the relevant government authorities. Consolidations and changes in the published schedule, aircraft type, days of operation, air carrier providing air transportation and flight itinerary may be undertaken at any time and without prior notice, in accordance with the air carriers tariffs.
     
     
                    Schedule Check & Connecting Flights
    Flight schedules are subject to change without notice. Customers having purchased air only must reconfirm their return flight within 24 to 72 hours prior to the scheduled take-off time. The Journeys undertakes to notify customers reasonably in advance through means it deems appropriate of any schedule changes resulting in the advancement or delay of the flight departure times or in case of cancellation of a flight. Whenever customers book connecting flights, they must allow sufficient time to make their connection. No control can be exercised over air carriers to guarantee flight schedules, which may be altered or affected by various circumstances. The Journeys will not be liable for any change of schedule or a missed flight connection, including any additional fees incurred and special, incidental or consequential damages (including the carriage of baggage) arising from the foregoing, whether or not it had the knowledge that such additional fees or damages might be incurred.
     
     
                   Airport check-in
    It is recommended that customers arrive at the airport check-in counter at least 3 hours prior to departure. Failing this, their reservation may be cancelled and their seats assigned to other customers, with no right to recourse.
     
     
                   Seat assignment
    Unless already pre-assigned, staff at the air carriers check-in counter conducts aircraft seating. 
     
     
                   Other applicable conditions
    Air transportation is subject to all applicable government regulations and is governed by the Montreal Convention, or the Warsaw Convention as the case may be, the applicable tariffs of the air carrier as well as the conditions of contract appearing on the airline ticket. Any amendments or changes to the applicable air carriers general terms and conditions of carriage once filed with and approved by federal regulatory authorities, are not subject to additional public notice and are legally binding.

    Refusal to transport
    Removal of passengers : The Journeys shall not be liable for refusal by itself or the air carrier to transport a passenger nor for the cancellation of a reserved space or removal of a passenger due to, but not limited to, safety reasons, to prevent the violation of any applicable laws of any country or to prevent any hazard or risk to such passenger, to any other person or property, or to the flight.
     
     
    Baggage
    Limits : Air carriers have individual rules and regulations with respect to baggage weight, size & number. Customers must consult with the Travel Agent for applicable restrictions.
     
    Liability : The provisions of the Montreal Convention, or the Warsaw Convention as the case may be, the applicable tariffs of the air carrier, as well as the notice appearing on the passenger ticket and baggage check, govern the loss of and damage to baggage and establish the limits of air carriers liability. Baggage lost or damaged while boarding or disembarking a ship must be reported to the Pursers office prior to the ships departure from port or prior to leaving the local customs area. Passenger’s baggage and property are transported, stored and handled at owners risk at all times.
  •  Some events are part of normal unpleasant occurrences, which can happen when traveling abroad. The customer realizes this, solely assumes the consequences thereof and agrees that The Journeys cannot be held responsible for any damages owing to such occurrences.
     
    Living Standards : Customers are asked to bear in mind and accept that living standards and practices at the destination, and the conditions there with respect to the provision of utilities, services & accommodations may differ from those found in North America.
     
    Service disruptions : Some services including water, electricity, air-conditioning, security, sanitary conditions, pools, food, beverages and other services or benefits may be suspended or interrupted partially or completely during the customers stay. Likewise, depending on the occupancy rate of the hotels, la Carte dining may be replaced by buffet or vice versa.
     
    Activities : The Journeys cannot be held responsible for any accident or mishap occurring at the destination during the practice of activities in which the customers participate of their own free will and initiative.
  •  The Journeys shall not be liable for failure in the performance of any of its obligations, including without limitation, for any loss or damage resulting from any delay, cancellation, loss of personal belongings, illness, bodily injury, accident, death, deterioration of Travel Services, inconvenience, loss of enjoyment, disappointment or frustration, either mental or physical, due to: * An Act of God or Force Majeure.

    * A war, revolution, insurrection, riot, blockage or any other unlawful act against public order or authority, including an act of terrorism or threat thereof.
     
    * Fire, flood, explosion, earthquake, epidemics, quarantine, storm, lightning, tornado or adverse weather conditions.
     
    * Accident to or failure of an aircraft or equipment used in connection therewith, loss of or hijacking of an aircraft, or any shortage of or inability to provide labor, fuel or facilities.
     
     * Any strike, lock-out, labor dispute or other industrial disturbance whether involving The  Journeys employees, the employees of its service providers or others upon whom The Journeys relies.
     
    * Any government order, regulation, action or inaction or any failure to obtain the approval of a government authority having jurisdiction in the circumstances as may be required to the conduct of operations hereunder or any government or legal restraint upon such operation.

     * Others upon whom The Journeys relies for the performance of the whole or any part of any Travel Services hereunder;
     
    * Any other causes beyond the reasonable control of  The Journeys and any other event not reasonably to be foreseen, anticipated or predicted, whether actual, threatened or reported, which may interfere with the operations of The Journeys or of its service providers.
  •  The Journeys acts only in the capacity as an agent for the hotels, airlines, bus companies, railroads, ship lines, and/or contractors providing accommodations, transportation or other services and as such, purchases such transportation, hotel accommodations, restaurant and other services from various independent suppliers. The Journeys does not control the operations of these suppliers of services and as a result, cannot be held liable for any personal injury, property damage or other claim which may occur as the result of any wrongful, negligent or arbitrary acts or omissions on the part of the independent supplier, agent, its employees or others who are not under the direct control or supervision of The Journeys; or for defects or failures of any vessel, aircraft, vehicle or other instrumentality which is under the control of an independent supplier; or loss, injury or damage to person, property or otherwise, resulting directly or indirectly from any Acts of God, dangers, incidents at sea, fire, breakdown in machinery or equipment, or wars (whether declared or not), hostilities, civil disturbances, strikes, riots, thefts, pilferage, medical epidemics, quarantines, or customs regulations, defaults, delays or cancellations or alterations in itinerary due to schedule changes, or from any causes beyond its control. Further, The Journeys is not liable for any loss or damage resulting from insufficient or improperly issued passports, visas or other legal documents. All coupons, exchange orders, receipts, contracts and tickets issued by The Journeys are issued subject to any and all tariffs, terms, and conditions under which any services are provided by such hotels, airlines, bus companies, railroads, ship lines or owners or contractors or by their person in employ. The Journeys (when deemed necessary) reserves the right to cancel any itinerary or any part of it or to make any alterations to the itinerary (including, but not limited to, alterations to substitution of hotels), and decline to accept or to retain any person as a tour passenger should such person’s health, mental or physical condition, in the sole opinion of The Journeys, impede the operation of the tour of the other passengers. In such a case, The Journeys will refund any monies that can be recovered for the unused portion of the tour, taking into account any additional charges incurred. Other than to refund such sum, The Journeys will accept no further liability or obligation toward that person or third party.
  •  The payment for a reservation on a published tour or customized itinerary shall constitute consent to all provisions in the terms & conditions list published herein. Please be aware of the hazards of traveling in undeveloped areas as your participation in a The Journeys safari or holiday may create certain risks and dangers including but not limited to the forces of nature, political unrest, travel by boat, train, automobile, aircraft or other means of conveyance, accident or illness in remote regions without means of rapid evacuation or medical facilities. The Journeys will not have liability regarding provision of medical care or the adequacy of any care that may be rendered. You are voluntarily participating in these activities with the knowledge of dangers involved and hereby agree to accept any risks.
     
    AS LAWFUL CONSIDERATION for the agreement with The Journeys to participate in such trips and activities you hereby agree that you will not make a claim against The Journeys, or sue for bodily injury, emotional trauma, death and/or property damage, however caused, as a result of your participation in the safari or holiday. You therefore release The Journeys and its employees from any and all claims, known or unknown, arising from your participation in a tour. This release of Liability and Assumption of Risk agreement is entered into on behalf of all members of your family including minors accompanying you. This agreement is binding on your heirs, legal representatives and assigns. If any portion of this agreement is unenforceable, the remaining portions shall remain in full force and effect. Any litigation involving this contract and any of our published or customized safaris and holidays can be brought only in courts of competent jurisdiction in the province of Ontario.
  •  The Journeys strictly complies with principles of confidentiality with respect to customers personal information, including in accordance with the Personal Information Protection and Electronic Documents Act.
