In completing & submitting the Booking Form & Deposit & / or final Payment, you acknowledge receipt & acceptance of these Terms & Agree to be bound by these conditions which constitute the Agreement between The Journeys & you. These conditions apply to the exclusion of any other Terms or Conditions unless they are set out in the Booking Form or are otherwise agreed to in writing by the Parties.

To reserve your place on one of our Journeys, you should complete the Booking Form & forward it, together with a Non-refundable Deposit of $ 300.00 per Person per Trip. Some Journeys ‘may’ require an additional Non-refundable Deposit or instant ‘full’ Payment for a Permit or Airfare. Reservations made for travel within 60 days will require full payment at the time of Reservation. Please refer to your individual Proposal & the Terms detailed below, for a more detailed explanation.

Early Reservations are recommended. All Services are strictly on a ‘request’ basis, both for Air & Land and subject to availability of Seats & Rooms at the Hotel / Lodge / Camp. In the event of Services requested not being available, alternative Services will be offered. If alternative Services are not acceptable, your initial Deposit amount will be refunded in full. Some Suppliers may require higher Deposit for specific Dates / Properties & the same will be advised to you prior or at the time of Booking. Please be aware that all Airfares mandate instant purchase to lock in the Price & consequently, full payment for the Airfare will be required at the time of Booking. Specific or special Conditions, if any, will be mentioned in your personalised Proposal accordingly.

Accommodations is on Twin Occupancy basis in a Room, provided at the Hotels / Lodges / Camps as specified or similar. Single Room Supplements apply to persons occupying sole use of the Room but travelling with other Passengers on the same Safari or Holiday & sharing cost of Transfers, Game Dives, Sightseeing & Excursions.
Single Room does not necessarily mean Single occupancy of a Double Room, as some of the Hotels / Lodges / Camps have specially designed Single Occupancy Units. Though, The Journeys will make all possible efforts to accommodate all Requests, due to limited accommodation, Single Rooms may not be available, in certain places.
A Single individual requesting sole use of Hotel Room & exclusive private use of all Services, including ground transportation for Transfers, Game Drives, Guided Sightseeing & Excursions, may request a special Single Rate.
Requests for Upgrading the Rooms are subject to additional charges. Handicapped or non-smoking Rooms are always on a request basis, subject to availability at no extra cost. All Hotel Taxes & Service charges & Government Taxes are included in the Tour Price. Some Cities have commenced applying a Hotel Tax, which cannot be added to the Invoice & has to be paid every night, directly. In those cases, Guests have to pay directly (details & amount will be mentioned in the Proposal or Itinerary).
The Journeys reserve the right to substitute Hotels should conditions warrant such change for reasons beyond our control. Rooms are assigned by the respective Supplier(s) as on a run-of-the-house basis, in category(s) as specified in the Itinerary. YOU acknowledge & accept that Hotels, in accordance with international standards, request that occupants Check-in between 02.00 - 03.00 pm & Check-out by 12.00 noon, on the scheduled day of departure or the day immediately preceding a late night departure.
Living standards & practices at the Destination & conditions with respect to the provision of Utilities, Services & Accommodation may differ from those found in North America & so, a little flexibility by the Traveler leads to a more enjoyable experience.

Meals, as included on individual Safaris & Holidays are either Buffet Meals and / or Table d'hote. Meals ordered through Room Service are not included & must be paid directly to the Establishment.
At times, special Meals & Entertainment are included as shown in the Itinerary. Some Meals may be provided at ‘standard’ Restaurants outside the Hotel. Included Meals are based on the Restaurant's set Menu or Buffet & usually represent local Cuisine. Vegetarian meals are available in most locations, while Vegan, or Gluten-free Menus are rare. Special Dietary requests, advised to us at the time of Booking, will be forwarded to the Suppliers but cannot be guaranteed unless confirmation is advised in writing. We are unable to provide Meals in accordance with strict Religious requirements, such as Kosher or Halal, nor can we accommodate specifically Salt-free, Protein-rich or Low-carb Meals.
Alcoholic beverages, soft drinks & bottled water are included only where indicated. Alcoholic beverages are generally to be purchased & paid directly to the Establishments (unless otherwise mentioned in the Itinerary).
The Food, Water & Beverages may not be up to North-American standards. Accordingly, Clients assume sole responsibility for any Illness suffered while abroad or upon return owing to the quality of the Food, Water & Beverages.

Any material proposed / published by The Journeys on the individual Proposal, Booking Form & these Conditions of Contract are not issued on behalf of & do not commit any Airline whose services are used or proposed to be used in the course of the Tour.
In the event that an Airline's proposed Travel or Fare schedule is amended or cancelled, such Amendment or Cancellation will not be considered a Cancellation of the Tour by The Journeys.
Any flights forming part of the Tour arrangements are subject to the conditions of the carrying Airline, which in most cases limits the Airlines' liability to Passengers in accordance with applicable International Law & Conventions.
The Airlines used in conjunction with Safaris & Holidays featured on our websites are not to be held responsible for any act, omission or event during the time Passenger(s) is / are not onboard their Aircraft. The Passenger Tickets in use by the Airline, when issued, shall constitute the sole Contract between the Airline & Passenger/s.
If you are purchasing a non-refundable Ticket from The Journeys, please ensure that you are provided detailed regulation governing such Airfares. The Journeys cannot be held responsible for any Change & / or Cancellation penalties associated with non-refundable or Airfares.
Tickets are made out in the name of the Traveler & are not transferable. Tickets are valid only on the dates & flights indicated. Unused portions of Tickets may not be used for travel on other flights & are not Refundable.
Flight schedules are subject to change without notice. Customers having purchased air only must reconfirm their return flight within 24 - 72 hours prior to the scheduled take-off time. The Journeys undertakes to notify the Clients reasonably well in advance through means it deems appropriate, of any schedule changes resulting in the advancement or delay of the flight departure times or in case of cancellation of a flight.
For connecting flights, it must be ensured that there is ample time to make their connection. No control can be exercised over the Airlines to guarantee flight time & schedules, are adhered to.
The Journeys will not be liable for any change of schedule or a missed flight connection, including any additional fees incurred & special, incidental or consequential damages (including the carriage of Baggage) arising from the foregoing, whether or not it had the knowledge that such additional fees or damages might be incurred.
It is recommended that Clients must arrive at the Check-in Counter at least 3 hours prior to departure. In case of reporting late or a No Show, their Reservation may be cancelled, with no right to recourse & The Journeys will assume no liability.
All Carriers have individual rules & regulations with respect to Baggage weight, size & number. Checked Bags are typically limited to a total dimension of 62 inches by adding length + width + height (example: 26" + 26" + 10" = 62"), and a maximum weight of 50 lbs (23kg). Many ‘major’ Airlines apply charges for Checked Bags. Some Airlines do not allow Checked baggage at all. Where available, we highly recommend selecting Airfares which include at least 1 piece of Checked baggage. The Journeys is not responsible for Checked Bag Fees & access Luggage or Weight charges levied by an Airline.

The Pices quoted on The Journeys are for payment by Cash, Cheque, Bank Transfer or Credit Card. Price quoted is also subject to provisions under the conditions detailed at Paragraph 8 of this Contract.
The balance of the Tour price is payable to The Journeys at least 60 days prior to Departure. Prices are quoted in Canadian Dollars (unless otherwise specified) & all payments must be made in CAD. If Booking is initiated 60 days prior, full Payment is required immediately.
If payment of the balance of the Tour Price is not received by The Journeys by the due date, it will be presumed that YOU have decided to not to travel & Cancellation Charges, if applicable, in accordance with the date range listed in Paragraph 11 will apply.

Visa, MasterCard & American Express Credit Cards are accepted as form of payment. Credit Card payments require that the Traveler complete & sign the Authorization Form & return the same to The Journeys. No Services will be provided without receipt of the hard-copy of the signed Authorization Form. 3rd Party Credit Cards have restrictions (to be advised, if).

Prices are per Person based upon shared Occupancy in a Twin-bedded Room. Prices do not include items of a personal nature i.e. Room Service, Laundry, Baggage charges, Telephone Calls, Internet, Fax, Beverages, Medical or emergency Search or Evacuation Expenses, Insurance, Gratuities & Tips, Camera / Video Fees wherever applicable, at the Monuments, any Meals not specifically listed in the Itinerary, any Optional Programs / Services, Passport / Visa / Vaccination charges, Departure Tax & additional expenses caused by Delay, Disruption or Accidents during the planned Itineraries. Unless specifically indicated in the Proposal.
In case of human or computer error or a drastic Price increase, The Journeys reserves the right to amend the Tour Price without notice at any time before the Departure Date & re-invoice with the correct Price or Service.
Accommodations & Services at the destination are contracted in local currencies & / or US Dollars. Package prices are based on local Costs, Taxes, Fuel prices, Airfares, Exchange Rates & assumptions made at the time of the final Quote in individual written Proposals.
The Journeys tries its utmost not to increase Tour prices (in full or part). However sometimes, increases are beyond the control of our local Partners. Amendments may be necessitated for many reasons including, but not limited to drastic Exchange Rate fluctuations, Government Taxes, increased Fuel Costs, Airfares or Service Fees.
The Journeys therefore, cannot warrant that Prices will not change & an increase must be borne & paid for upon demand prior to the Departure Date. Consequently, please note that all Airfares & Package rates are subject to change without notice until the time Full Payment has been received.
However, once the Tour Price is paid in full, the Client is guaranteed against future increases provided the Client makes no change to the Itinerary.
When we are given advance notice by the Supplier of price increase in excess of 7% (excluding GST / PST / HST or any other Government Taxes) & if we have received your Deposit, YOU would be given the opportunity to pay in full to avoid such increase (should it occur) or you will have the right to Cancel your Booking & obtain a Full Refund of your Deposit.

Changes to itinerary are subject to a $50.00 Service Fee per Change. Additional services are exempt from this charge. Any Changes made after the Travel Documents have been issued will be subject to $50.00 Service Fee per change & in addition, there may be a Change Fee stipulated or applied by respective Destination Partner.

The Journeys reserves the right to Postpone, Cancel or Delay (either in relation to the Departure or Arrival times or the Duration of the Tour) the date of Departure or conclusion of the Tour or modify or cancel any aspect of the Tour or modify any Routes within the Tour as set out in the Itinerary, for reasons beyond our control such as inclement, hazardous or dangerous Weather, Acts of War or Terrorism, Government or Political Actions, Strikes & Trade Disputes, Fire, Breakdowns or Interruption of Transport, Government Travel Advisory (or any change in such Warning or Advice) or any other adverse or threatening conditions
In the event of any such Change, Modification, Cancellation, Postponement or Delay under this condition, YOU acknowledge that you will have NO right of Refund of the Tour Price (whether in whole or in part) & no right to claim Compensation for any Injury, Loss or Damage or other additional Expenses incurred by virtue of the Change, Modification, Cancellation Postponement or Delay. Travel Protection Insurance may compensate you depending on the circumstances.

If you wish to cancel your Tour, you must notify us in writing. All Cancellations become effective when the written notice is received at The Journeys office & receipt acknowledged on the next day. Subject to the following Per Person Penalties:
- 60 days prior to Departure: Loss of the non-refundable Deposit of $300.00 + Travel Insurance Premium (if applicable) **
- 59 - 30 days prior to Departure: 50% of total Tour Price + Travel Insurance Premium (if applicable) **
- 29 - 0 days prior to Departure: 100% of total Tour Price + Travel Insurance Premium (if applicable) **
** Plus any unrecoverable Deposits paid to Airlines & / or Ground Handling Operators in Destination. As well, Suppliers of other Services may apply an additional Fee to the abovementioned Cancellation Charges.Airfares are subject to different Rules & Cancellation Fees. Some Airfares may be non-refundable once the Ticket is issued. Details will be advised at the time of Booking.
No Refund will be made for any unused Accommodations, missed Meals or Transportation segments or Sightseeing or any other Service. Such unused Components are neither refundable nor exchangeable.

In the very remote possibility that the Tour cannot commence & / or continue due to circumstances beyond our control, The Journeys may, in its sole discretion, postpone, cut short or cancel the Tour at any time. Such Changes & / or Cancellations may be necessitated for reasons of Political, Military, Safety, Health, Weather conditions or other valid reasons affecting local conditions, but will not be limited to the aforesaid reasons only. Travel Protection Insurance is recommended due to this rare but potential unforeseen eventuality.
The Journeys also reserves the right to Cancel any Tour prior to Departure in the event that there are too few people booked on a Tour which requires a minimum number to operate. In this case, YOU will be given a full Refund of the Tour Price paid by you. You will not be entitled to claim any additional amounts or seek any compensation for any Injury, Loss, Expenses or Damage (either direct or consequential) or for any loss of Time or Inconvenience which may result from such Cancellation (including but not limited to Visa, Passport & Vaccination charges etc.)
The Journeys will have no further liability to the Client for Damages or Inconveniences caused to the Client & the Client hereby expressly waives any claim he / she may have against The Journeys for such a Cancellation.

If The Journeys is prevented (directly or indirectly) from performing any of its obligations under this Agreement by reason of Act of God, Acts of War or Terrorism, Government or Political Actions, Strikes & Trade Disputes, Fire, Breakdowns or Interruption of Transport, Acts or Omissions of a 3rd Party or for any other cause whatsoever outside The Journeys reasonable control, The Journeys will be under no liability whatsoever to YOU & may, at its option, by written notice to you, either cancel the Tour or take any other action as specified.
The Journeys also reserves, in its absolute discretion, the right to Cancel any Tour due to any Government Travel Warning or Advice or any change in such Warning or Advice. Travel Protection Insurance is recommended due to this rare but potential unforeseen eventuality & may compensate you, depending on the stipulated circumstances.

Check with your Healthcare provider for up-to-date requirements. You may also check the US Centers for Disease Control & / or the World Health Organization for their recommendations.
Health regulations for some countries visited on Safaris & Holidays may require proof of any required Inoculation that must be recorded on a valid Inoculation Certificate in your possession for inspection at Customs / Immigration, if required. Please be aware that entry into other countries immediately after a Safari or Holiday in parts of Africa, may require valid Yellow-fever Inoculation, in addition & Entry into that country may still be denied even when travelling with proper & valid Health documents (never happens but legally stipulated).
Individuals with Heart disease, chronic Illness, physical Handicap, advanced Pregnancy, or Mental illness should not participate in these rigorous travel programs. Any person who arrives to the Destination ill with apparent Fever or becomes ill during the Tour, will be directed by our local Partner, to the nearest Medical facility for diagnosis. Only upon written clearance by an accredited Medical facility, the Guest will be allowed to resume group travel & participate in the remaining activities of the Tour.
All Costs associated with Medical Diagnosis or Treatment & related expenses such as additional Hotel nights or Transportation not included in the original itinerary, will be the responsibility of the Passenger. YOUR Travel Protection Plans will only consider Coverage & Reimbursement with Documentation & Receipts for services provided by legally qualified & accredited Health Care facilities, recommended by your Insurance Provider, in accordance with policy terms
YOU acknowledge that the obligation to disclose under this condition continues from the time of Booking through to Departure & extends for the duration of the Tour.

It is the full responsibility of Travelers to obtain, at their own expense, all necessary Tavel Documents & must check with the respective Consulate(s) or Visa Agency to determine whether any Visas or Passports are required for current Entry requirements, by all relevant Government authorities, including all Ports of Call & to comply with the laws thereof. A Visa or Visas may be required for some or all of the countries visited on the selected Safari or Holiday. Where Pre-authorisation / Invitation is required to apply for a Visa, The Journeys will assist in acquiring same. It is imperative that YOU also check the Visa requirements, if any, for all of the Destinations you will be Transiting through.
A Canadian or US Citizen must be in possession of a Passport that must remain valid for a minimum of 6 months beyond the dates of conclusion of their journey. Some countries require a full blank page in the Passport for stamping purposes. Clients must also ensure that they comply with all Health requirements of countries they intend to visit. It is the Passenger’s responsibility to ensure that all his or her Passport & Visa requirements are met & make certain that all the necessary Documents are available prior to Departure. If Visas are denied for any reason, The Journeys cannot be held responsible for any expense or inconveniences caused. Please note that Entry to another country may be refused even if the required information & Travel Documents are complete & in order.
Canadian or US Citizens born in certain countries may require a Visa in addition to a valid Passport. Non-Canadian or US citizens may have different requirements. A Permanent Resident Card / Green Card will be required for Permanent Residents / Landed Immigrants who are not Canadian / US Citizens.
The Carrier or relevant authorities, without further recourse or the possibility of a Refund, may deny Boarding privileges for those failing to provide the required Documents. YOU will not be entitled to a Refund if you are denied Boarding or Entry on any basis, including without limitation, improper Documentation or failure to provide information.
The Journeys shall not be held liable for any aid or information given by its Employees or the affiliate Travel Agent, in connection with obtaining any necessary Travel Documents or complying with any Laws, whether given orally, in writing or otherwise, or for the consequences suffered by any Client resulting from his / her failure to obtain such Documents or to comply with such Laws. Any information provided, based on current publicly available information on the I Internet, is advisory & Client must research directly.
Final Tour Documents consisting of detailed Itinerary, Vouchers (if required), List of Hotels with address & Telephone #s & Airline Tickets (if purchased through our Office) & a Contact List with all Names & Emergency 24 / 7 Telephone #s of our local Offices, will be forwarded subsequent to receipt of final Payment & latest 2 weeks prior to departing.

In some countries & regions, standards of Accommodation, Transport, Health Care, Hygiene, Safety & Service provision generally are often not as high as standards in our country & that may require flexibility & patience on your part.
Operational control of the Tour may be in the hands of a 3rd Party & your right of action in regard to any shortcomings of that 3rd Party’s performance is against the 3rd Party & not against The Journeys.
YOU are aware that travel to a foreign country such as that you are undertaking may involve hazardous activities, with a risk of Illness, Injury or Death which may be caused by forces of Nature, Animals, Insects or the negligence of other Persons & Companies known or unknown, or of willful or criminal conduct of 3rd Parties. YOU are aware that you may encounter severe, adverse or unpleasant Weather conditions may be severe. YOU are also aware that Medical Services or Facilities may not be readily available or accessible during some or all of the time during the course of this Journey.
However, in order to partake of the enjoyment & excitement of this trip, YOU are willing to accept the risks & uncertainty involved as being an integral part of the adventure. YOU hereby accept & assume full responsibility for any & all risks & agree to hold harmless & release The Journeys from claims of 3rd Party negligence. YOU understand the physical requirements of the activity in which you will be participating & you currently have no known Physical, Medical or Mental condition which would impair your ability to participate in this Tour & you are willing to assume all risks that may be created, directly or indirectly, by any such condition.
The Client acknowledges that he / she is aware that there are Travel Advisories, Travel Warnings & Government directives advising & / or prohibiting their Citizens from traveling to certain countries. There may be similar further directives issued prior to the Tour.
For the above reasons, YOU therefore accept the inherent & increased Dangers & Risks associated with the proposed Tour & the accompanying risk of Injury, Death or Property Damage or Loss.
YOU have submitted your Booking for the Tour after giving due consideration of relevant Travel information including, without limitation, any relevant information or advice given by the Government of Canada & US Department of State & that it is your responsibility to acquaint yourself that information or advice.
YOU hereby authorize The Journeys or our local Destination Partner or others to arrange for any emergency Medical Treatment & Hospitalization as may be necessary for you because of participation in this activity without your further consent.

Additionally, our Travel Documentation include a Contact List with names & Phone #s of our local Reps in every City that you visit in a Destination, who are available 24 / 7 in case of an Emergency. Also, we keep a constant track from our Toronto office & Clients are happy to receive our call every 4 -5 days to enable them to offer their feedback / comments. We do appreciate that in-spite of careful planning & personalised service, things can sometimes still go wrong, but rest assured, we will be there to help & support you, if.

In that case, you must provide evidence to The Journeys prior to Departure that you have obtained personal Travel Protection Insurance Plan with the relevant Coverage.
Personal Travel Insurance is not included in the Tour Price. It is YOUR responsibility to ensure that you are adequately insured for the full duration of the Tour in respect of Illness, Injury, Death, Loss of Baggage & personal Items and Cancellation & / or Interruptions. In the event of Illness, Medical & Emergency expenses are the Traveler's responsibility & no Refunds will be made, partial or total, for the purchased journey, if interrupted.
To protect against Cancellation charges, we strongly recommend purchasing Cancellation Protection & Travel Interruption Insurance. Travel Protection helps with Medical coverage for Illness, Accident or Injury, Emergency Evacuation, Trip Cancellation & /or Interruption, Baggage Loss & more.
Although, you may choose to purchase adequate Travel Protection (Cancellation Insurance & / or comprehensive All Inclusive Insurance) at any time before you complete Final Payment, we recommend that you take a decision at the time of initial Deposit. Most Travel Protection Plans allow a 10 day Review Period & subsequently, the Premium is non-refundable.
In addition, you must be medically able to travel at the time the Premium is paid. For a summary of the Plan details on Coverages, Benefits, Limitations & Exclusions, please refer to the description of Coverage by respective Providers.

The Journeys acts only in the capacity as an Agent for the Hotels, Airlines, Transporters, Railroads, River Cruises & / or Partners providing Accommodations, Transportation or other services & such, purchases such Transportation, Accommodation, Meals, Tour-guide & other relevant Services from various independent Suppliers.
Operational control of the Tour may be in the hands of a 3rd Party & your right of action in regard to any shortcomings of that 3rd Party’s performance is against the 3rd Party & not against The Journeys. All such Persons & Entities are independent Contractors.
The Journeys, its Officers, Employees & Affiliates, (collectively “The Journeys”) does not own or operate any entity which is to or does provide Goods or Services for your Trip including, for example, ownership or control over Hotel or other Lodging facilities, Airlines, Transport vehicles, local Ground Operators, Providers or Organizers of optional Excursions or equipment used thereon.
The Journeys does not control the operations of these Suppliers of Services & consequently, cannot be held liable for any personal Injury, Property damage or other claim which may occur as the result of any wrongful, negligent or arbitrary acts or omissions on the part of the independent Supplier, Agent, its Employees or others who are not under the direct control or supervision of The Journeys; Or for Defects or Failures of any Vessel, Aircraft, Vehicle or other instrumentality which is under the control of an independent Supplier; Or Loss, Injury or Damage to Person, Property or otherwise, resulting directly or indirectly from any Acts of God, Dangers, Fire, breakdown in Machinery or Equipment; Or Wars (whether declared or not), Hostilities, Civil Disturbances, Strikes, Riots, Thefts, Pilferage, Medical Epidemics, Quarantines; Or Customs regulations, Defaults, Delays or Cancellations or Alterations in the Itinerary due to schedule changes, or from any causes beyond its control. Further, The Journeys is not liable for any Loss or Damage resulting from insufficient or improperly issued Passports, Visas or other legal Documents.
YOU release, waive, discharge, hold harmless & agree to indemnify The Journeys & its Officers, Employees, Agents, Guides & other Representatives & the Ground Handling Operators in the countries in which the Tour is conducted, from ALL Claims, Actions or Losses for bodily Injury, Property damage, wrongful Death, loss of Services, loss of Profits, Consequential, Indirect or Punitive Damages or otherwise, which may arise out of or occur during your Travel in connection with the Tour or any activities conducted in conjunction, unless caused by the wilful Negligence or wrongful Act of The Journeys & its Employees. And regardless of the situation or circumstances giving rise to the Claim, YOU waive any Claims you have, or may at any time have, against The Journeys & its Employees & YOU agree, by accepting the additional inherent Dangers & Risks associated with the Tour, not to make any Claim against or seek any Compensation from The Journeys & its Employees in respect of any personal Injury, Illness or Death or loss of Property sustained by you as a result of your participation in the Tour.
Without limitation, The Journeys is not responsible for any Injury, Loss, or Damage to Person or Property, Death, Delay or Inconvenience in connection with the provision of any Goods or Services occasioned by or resulting from, but not limited to Force Majeure, Acts of Government, Acts of War or Civil Unrest, Insurrection or Strikes or other Labor activities, Criminal or Terrorist activities of any kind, or the Threat thereof, Overbooking or Downgrading of Accommodations, structural or other defective conditions in Hotels or other Lodging facilities, Mechanical or other failure of Airplanes or other means of Transportation or for any failure of any Transportation mechanism to arrive or depart timely or safely, Diseases & dangers associated with or Bites from Animals, Pests or Insects, Marine life or Vegetation of any sort, dangers incident to recreational activities such as Water Sports, Hiking, Walking, Cycling etc., Sanitation problems, Food Poisoning, lack of access to or quality of Medical care, difficulty in Evacuation in case of a Medical or other Emergency, Illness, Epidemics or the threat thereof or for any other cause beyond the direct control of The Journeys.
All Coupons, Exchange Orders, Receipts, Contracts & Tickets issued by The Journeys are issued subject to any & all Tariffs, Terms & Conditions under which any Services are provided by such Hotels, Airlines, Transporters, Railroads, River Cruises or Owners or Contractors or Employees.
The Journeys (when deemed necessary) reserves the right to cancel any Itinerary or any part of it or to make any alterations to the Itinerary (including, but not limited to, alterations or substitution of Hotels) & decline to accept or to retain any Person as a Tour passenger should such Person's Health, Mental or Physical condition, in the sole opinion of The Journeys impede the operation of the Tour of the other Passengers.
In such a case, The Journeys will refund any monies that can be recovered for the unused portion of the Tour, taking into account any additional Charges incurred. Other than to Refund such sum, The Journeys will accept no further Liability or Obligation toward that Person.
YOU have submitted your Booking for the Tour after giving due consideration of relevant Travel information including, without limitation, any relevant information or advice given by the Government of Canada & US Department of State & that it is your responsibility to acquaint yourself that information or advice.

YOU declare that you are in good Health & you have disclosed to The Journeys every matter concerning your Mental & Physical fitness, of which you are aware or reasonably be expected to know & that permits you to travel on this Tour. YOU acknowledge that the obligation to disclose under this condition continues from the time of Booking through to Departure & extends for the duration of the Tour.

The payment for a Reservation on a published Tour or customized Itinerary shall constitute consent to all provisions in the Terms & Conditions clauses listed herein. Please be aware of the hazards of traveling in undeveloped areas as your participation in a The Journeys Safari or Holiday may create certain risks & dangers mentioned in Paragraph 16 above.
The Journeys will not have liability regarding provision of Medical Care or the adequacy of any Care that may be rendered. You are voluntarily participating in these activities with the knowledge of Dangers involved & hereby agree to accept any risks.
Aa lawful Consideration for the Agreement with The Journeys to participate in such Trips & activities, YOU hereby agree that you will not make a Claim against The Journeys for bodily injury, emotional trauma, death and / or property damage, however caused, as a result of your participation in the Safari or Holiday.
You therefore release The Journeys & its Employees / Affiliates from any & all Claims, known or unknown, arising from your participation in a Tour. This Release of Liability & Assumption of Risk Agreement is entered into on behalf of all members of your Family or Party, including minors, accompanying you. This Agreement is binding on your Heirs, legal Representatives.
Any Litigation involving this Contract & any of our published or customized journeys can be brought only in Courts of competent Jurisdiction in the province of Ontario.
